Our office only handles Chapter 7 Bankruptcy. In a Chapter 7 bankruptcy all of your dischargeable debts are eliminated. There are certain debts which will not be discharged, such as student loans. However, in order to file a Chapter 7 bankruptcy you need to have income under a certain level. The exact amount varies by the number of people you have in your household. Bankruptcy under Chapter 7 allows you to protect certain assets from the trustee. In most cases the exemptions are enough to protect most if not all of your property. What is not able to be exempted, the trustee sells and provides the money from that sale to your creditors in accordance with the bankruptcy code.
